Last updated: 2026-08-23. These terms apply to video production services ("Services") sold under the Territory name by Gabriel Homoky ("we", "us"), Hungary. Territory is a studio by Automating.
An order is confirmed when you accept a written quote (email is fine) and pay the deposit. The quote states the scope, price, delivery date and number of revision rounds. Anything not in the quote is out of scope.
50% of the price is due before work starts, 50% on delivery of the final files. Payment by card or bank transfer in USD, EUR or GBP. Prices exclude VAT; for business customers outside Hungary the reverse-charge rule or the out-of-scope rule applies and no Hungarian VAT is charged. An invoice is issued for every payment.
You confirm that you have the right to use the photos, plans, figures, disclosure documents and logos you send us, and that we may use them solely to produce your film. We do not publish your materials or your film without your permission, except for concept samples explicitly labeled as samples and built from publicly available franchising pages and brand photos.
You receive the film in the formats stated in the quote. One revision round is included unless the quote says otherwise. If the first cut is not usable and a revision cannot fix it, the deposit is refunded and the engagement ends.
On full payment we grant you a broad, perpetual, worldwide, irrevocable, royalty-free license to use, copy, edit, distribute and sublicense the delivered film for marketing your franchise opportunity and your business, and we assign to you whatever copyright subsists in the delivered work. Parts of the film are produced with AI tools; unmodified AI-generated elements may not attract copyright protection in some jurisdictions (notably the United States and the European Union). We do not warrant that you will hold an enforceable copyright in such elements. Our production templates, tooling and processes remain ours.
Our films use software-generated motion and may include AI-generated shots derived from your photos. Every delivered film carries an "AI-assisted" notice on the end card. You agree not to remove this notice where disclosure is required by law (for example the EU AI Act, Article 50).
Every figure shown on screen is taken from your Franchise Disclosure Document (FDD) or from material you provide. Figures that could constitute a financial performance representation are shown only if they already appear in Item 19 of your current FDD (16 CFR 436.9(c)): you and your counsel select the figure or figures, they appear on one card, with the Item 19 reference statement your counsel requires and the FDD year, and never as averages, projections or estimates created by us. If your state requires franchise advertising to be filed before use, we deliver a file-ready cut with that statement burned in; the filing itself is yours. You are responsible for reviewing the delivered film with your franchise counsel and for compliance with the FTC Franchise Rule (16 CFR Part 436) and state franchise laws before publishing it. We do not provide legal advice.
Our total liability under an order is limited to the amount you paid for that order. We are not liable for indirect losses, lost candidates, lost franchise sales or lost profits.
Hungarian law applies. Disputes go to the competent courts of Hungary, without prejudice to mandatory consumer rules that may apply to you.
